UMA ANÁLISE CONSTITUCIONAL E SOCIAL EM RELAÇÃO A PROPOSTA DE REDUÇÃO DA MAIORIDADE PENAL
O presente artigo objetiva-se em fazer uma análise preliminar de alguns aspectos constitucionais e Sociais sobre a proposta de redução da maioridade penal. No mesmo passo, abordar-se-á algumas discussões doutrinárias a respeito do tema. Nesta perspectiva, é utilizada a metodologia da pesquisa bibliográfica que é por meio de leituras de teorias, as quais são analisadas pelo método qualitativo, ou seja, resguarda as qualidades discursivas sobre o assunto por se tratar de pessoas. E tem como resultados as abordagens argumentativas a favor e contra a referida proposta. E como complemento é feita uma exposição do artigo 228 da Constituição Federal de 1988, a fim de mostrar que o mesmo representa uma “cláusula pétrea” por ser passível de reforma ou emendas constitucionais para melhoria da qualidade de vida das crianças e dos adolescentes na sociedade brasileira.

Abstract:
This article aims to make a preliminary analysis of some constitutional and social aspects of the proposal to reduce the age of criminal responsibility. In the same step, some doctrinal discussions on the subject will be addressed. In this perspective, the methodology of bibliographical research is used, which is through readings of theories, which are analyzed by the qualitative method, that is, it protects the discursive qualities on the subject because it is about people. And it has as results the argumentative approaches in favor and against the referred proposal. And as a complement, an exposition of article 228 of the Federal Constitution of 1988 is made, in order to show if it represents a “rock clause” for being subject to constitutional reform or amendments to improve the quality of life of children and adolescents in Brazilian society.
