UM DIÁLOGO ENTRE TÊMIS E HIGÉIA: PENSAR OS OBSTÁCULOS EMERGENTES NA PROMOÇÃO DO DIREITO À SAÚDE EM TEMPOS DE PANDEMIA DA COVID-19 NO CENÁRIO BRASILEIRO
O escopo do presente é analisar a efetivação do direito à saúde em tempos de pandemia. Como é cediço, a pandemia provocada pela COVID-19 foi responsável por produzir, em escala global, a alteração dos mais diversos padrões, em razão da difusão, contaminação e taxa de mortalidade. No Brasil, tais efeitos não foram diferentes e questões sensíveis e próprias do contexto nacional tornaram-se ainda mais emergentes. Neste aspecto, pode-se afirmar que a pandemia foi responsável por trazer à mostra a fragilidade social vivenciada por parcela considerável da sociedade, cujos direitos mais essenciais foram diretamente afetados. Neste prisma, é importante pensar o direito à saúde que, em decorrência de sua natureza programática, expôs a situação frágil produzida pelo agravamento do contexto de vulnerabilidade. Assim, obstáculos e empecilhos são verificados na promoção do direito à saúde, o que compromete, via de consequência, a manutenção de um piso mínimo vital para a concretização da dignidade da pessoa humana. Como conclusões parciais, pode-se sustentar que, devido ao contexto multifacetado e socialmente heterogêneo e desigual, a promoção do direito à saúde, sobretudo com o contexto da pandemia da COVID-19, ainda é um desafio que reclama a atuação do Estado como agente concretizador de políticas públicas fomentadoras dos direitos programáticos. Como metodologia estabelecida, foram empregados os métodos histórico e dedutivo. Como técnicas de pesquisa, foram utilizadas a revisão de literatura sob o formato sistemático e a pesquisa bibliográfica.

Abstract:
The scope of this present is to analyze the realization of the right to health in times of pandemic. As is obvious, the pandemic caused by COVID-19 was responsible for producing, on a global scale, the alteration of the most diverse patterns, due to diffusion, contamination and mortality rate. In Brazil, such effects were no different and sensitive issues specific to the national context became even more emerging. In this respect, it can be said that the pandemic was responsible for bringing to light the social fragility experienced by a considerable portion of society, whose most essential rights were directly affected. In this perspective, it is important to think about the right to health which, due to its programmatic nature, exposed the fragile situation produced by the worsening context of vulnerability. Thus, obstacles and obstacles are verified in the promotion of the right to health, which consequently compromises the maintenance of a vital minimum floor for the realization of human dignity. As partial conclusions, it can be argued that, due to the multifaceted and socially heterogeneous and unequal context, the promotion of the right to health, especially in the context of the COVID-19 pandemic, is still a challenge that demands the role of the State as an agent implementer of public policies that promote programmatic rights. As established methodology, the historical and deductive methods were used. As research techniques, literature review under systematic format and bibliographic research were used.
