UM CAPÍTULO NA HISTÓRIA DO DIREITO URBANÍSTICO BRASILEIRO: ALCIDES CRUZ
O presente artigo tem por escopo apresentar os aspectos da obra do jurista Alcides Cruz (1867-1916) acerca da disciplina urbanística. O problema de pesquisa recai sobre a identificação dos mecanismos jurídicos empregados pelo autor para justificar a ampliação da atividade estatal no meio urbano. A hipótese testada é que eles repousavam nos conceitos de “intervenção” e de “polícia”, moldados para que pudessem validar a expansão do poder do Estado para instituir e aplicar a disciplina urbanística. Assim, empregou-se a metodologia da história dos conceitos para investigar, a partir da obra “Noções de Direito Administrativo Brasileiro”, de 1910, o alcance e significado de “intervenção” e “polícia”. Com isso, busca-se preencher uma lacuna na história do direito urbanístico brasileiro, ainda presa às narrativas superficiais dos manuais da disciplina.

Abstract:
The aim of this article to present aspects of the work of Alcides Cruz (1867-1916) on urban discipline. The research problem lies in the identification of the legal techniques used by the author to justify an expansion of state activity in the urban space. The tested hypothesis is that these techniques were linked to the concepts of "intervention" and "police", shaped so that they could validate the expansion of the State's power to impose and apply the urban discipline. Thus, we applied the methodology of conceptual history to the book "Noções de Direito Administrativo Brasileiro", from 1910, investigating the scope and meaning of "intervention" and "police". Our point was to fill a gap in the history of Brazilian urban law, still attached to the superficial narratives of the discipline manuals.
