Abstract: Adequate access to medicines is essential in the fight against HIV, directly impacting the quality of life of patients and the work of health professionals. This term paper discusses the legislation that controls the treatment and accessibility of HIV medicines, looking at how these guidelines affect the health system and society. The study analyzes regulatory frameworks such as Law No. 9.313/96, which ensures free access to medicines for HIV patients in Brazil. The legislation not only affects the quality of life of patients, but also influences the work of health professionals, who face challenges such as bureaucracy and the scarcity of medicines in certain regions. Despite some flaws in the SUS, the current legislation has a positive effect in guaranteeing free treatment in Brazil. However, legal and economic barriers persist, particularly in developing countries, which limit full access to treatment. It was concluded that these policies should be constantly reviewed, including increasing efforts to produce generic drugs and making patent laws more flexible in health emergencies.
