TRANSCONSTITUCIONALISMO: UMA REFLEXÃO SOBRE A INTERNACIONALIZAÇÃO DOS DIREITOS FUNDAMENTAIS / DIREITOS HUMANOS.
Este artigo intenta fazer uma análise dos Direitos Humanos e Direitos Fundamentais sob a ótica do Constitucionalismo e do Transconstitucionalismo, com base no Estado Democrático de Direito. E o necessário reconhecimento, pelo contexto da globalização, do entrelaçamento de ordens jurídicas diversas, tanto estatais como transnacionais, internacionais e supranacionais, em torno dos mesmos problemas de natureza constitucional. Posto que os problemas dos direitos fundamentais e da limitação de poder do Estado são discutidos, ao mesmo tempo, por tribunais de ordens diversas, como se verá, neste artigo, através do Transconstitucionalismo. Por meio de revisões bibliográficas, no método hermenêutico, procurou-se assinalar a crescente importância do Transconstitucionalismo, em prol dos Direitos Humanos. Para tanto, far-se-á uma rápida explanação sobre Direitos Fundamentais, Constitucionalismo e Transconstitucionalismo.

Abstract:
This article tries to make an analysis of Human Rights and Fundamental Rights from the point of view of Constitutionalism and Transconstitutionalism, based on the Democratic State of Law. And the necessary recognition, through the context of globalization, of the intertwining of diverse legal orders, both state and transnational, international and supranational, around the same problems of a constitutional nature. Since the problems of fundamental rights and the limitation of state power are discussed at the same time by different courts of order, as will be seen in this article through Transconstitutionalism. Through bibliographical revisions, in the hermeneutic method, it was tried to point out the growing importance of the Transconstitutionalism, in favor of Human Rights. To do so, a brief explanation will be made on Fundamental Rights, Constitutionalism and Transconstitutionalism.
