THE VOLUNTARY RECOGNITION OF THE FILIATION SOCIO-AFFECTIVE AND ITS IMPLICATIONS INTO LAW, FAMILY AND SOCIETY
A sociedade vem constantemente sofrendo transformações e uma delas, sentida fortemente nos últimos anos, refere-se ao conceito moderno de família, especialmente no aspecto da paternidade voluntária, construída a partir do sentimento socioafetivo, que igualmente merece proteção estatal, tal como a filiação biológica. Nessa perspectiva, tem-se o escopo de analisar o instituto do reconhecimento voluntário da filiação socioafetiva e seus impactos verificados no âmbito do ambiente familiar, na lei e na sociedade. Na ocasião, desenvolveu-se uma pesquisa bibliográfica, com abordagem qualitativa, utilizando-se de obras, normas jurídicas e decisões judiciais. Pretende-se chegar a resultados que apontem para um novo paradigma de sociedade plural, que passou a considerar cada vez mais a questão afetiva e sentimental no reconhecimento do parentesco familiar, evoluindo para a aceitação do liame socioafetivo como alternativa para a constituição de família. Assim, espera-se confirmar a hipótese de que os usos e costumes da população são dinâmicos e as normas que disciplinam as relações individuais, ou entre estes e o Estado, são estáticas. Por isso, os regramentos normativos necessitam de adequação e aprimoramentos que compreendam o conceito moderno de família, de maneira a favorecer a paternidade socioafetiva, prestigiar a dignidade da pessoa humana, o direito de personalidade e fortalecer a base da sociedade.

Abstract:
Many changes have occurred in Society and one of them, perceived strongly in the past few years, refers to the modern concept of family, especially in the aspect of voluntary, built from the socio-affective feeling, which equally deserves state protection, as well as biological parentage. In this perspective, the present paper aims to analyze the voluntary recognition of socio-affective paternity and its implications into law, family and society. Then, this study was elaborated through a bibliographic research, with a qualitative approach, using books, laws and court decisions. It is intended to obtain results that point to a new paradigm of plural society, which increasingly is considering the affective and sentimental issue for the family kinship recognition, evolving towards socio-affective affiliation acceptance as an alternative for family constitution. Thus, it is expected to confirm the hypothesis that the population's uses and customs are dynamic and the norms that discipline individual relations, or between them and the State, are static. Therefore, the laws need to be adapted and improved to understand the modern concept of family, in order to favor social-affective paternity, honor the dignity of the human person, the right to personality and strengthen the basis of society.
