Abstract: This work aims to demonstrate the existence, even today, of territories that are claimed by the indigenous peoples of Brazil, as well as the economic activities offered and developed in them, many of which cause the loss of their autonomy, identities and culture. With a Decolonial approach, we will deal with these very current issues that impact the lives of the original peoples of this country, such as leasing on indigenous lands and mining. In view of this, we have the following specific objectives: demonstrate the violation of article 231, § 2 of the 1988 Federal Constitution, which provides for exclusive use of indigenous lands by the indigenous peoples of Brazil; Analyze how Decolonial Theory can contribute to resolving conflicts involving indigenous lands in Brazil; Evaluate how the concept of indigenous land and territory can be significant in implementing the demarcation of indigenous territories. The research methodology chosen for this work was a literature review, using a Decolonial Theory approach, according to the worldview of indigenous peoples on the understanding of land and territory. With documentary research, data collection was also carried out.
