TEORIA GERAL DOS DIREITOS HUMANOS: DIREITOS HUMANOS COMO CONQUISTA HISTÓRICA E A CRISE DE REFUGIADOS NA ATUALIDADE
Trata o presente artigo de uma singela reflexão acerca da problemática concernente a imposição de um fundamento absoluto de direitos humanos na perspectiva de Norberto Bobbio, segundo o qual direitos humanos, muito embora apresentem a característica de direitos naturais, surgem conforme as modificações havidas na história e assim são conquistas obtidas em cada momento. Não podem por sua vez ser considerados imutáveis e absolutos como aponta os jusnaturalistas, pois a característica da sua heterogeneidade não permite. Em um segundo momento trata dos direitos humanos e a crise dos refugiados, fato histórico atual pelo qual passa o mundo contemporâneo, motivo pelo qual a aplicabilidade e eficácia dos direitos humanos deve nortear as ações e decisões dos governantes mundiais a fim de resguardar a vida humana, a dignidade das pessoas e a sua liberdade.

This article deals with a simple reflection on the problematic concerning the imposition of an absolute foundation of human rights in the perspective of Norberto Bobbio, according to which human rights, although they have the characteristic of natural rights, arise according to the modifications that have occurred in history and So are achievements at any given time. They can not in turn be considered immutable and absolute as the naturalists point out, since the characteristic of their heterogeneity does not allow.
