O artigo aborda os fundamentos

econômicos das transferências voluntárias

intergovernamentais entre os Estados

Federados e sua importância para assegurar a

autonomia financeira dos entes subnacionais.

Serão analisadas as espécies de transferências,

suas classificações e seus objetivos. Além

disso, serão apresentadas diretrizes para um

desenho de um sistema de transferências

intergovernamentais adequado: a flexibilidade,

a preservação da autonomia dos entes

federados, a previsibilidade e a regularidade

das transferências e a capacidade de não inibir

a arrecadação local.

O estudo dos temas fundamentais serve de

pano de fundo para a interpretação das normas

jurídicas pertinentes à matéria e para a solução

de conflitos entre os entes federativos no tocante

à distribuição de encargos e à distribuição de

recursos financeiros.

Abstract:
The article discusses the economic

fundamentals of voluntary intergovernmental

transfers between the Federated States and their

importance to ensure the financial autonomy of

subnational entities. The species of transfers,

their classifications and their objectives will be

analyzed. In addition, guidelines for designing an

appropriate intergovernmental transfer system

will be presented: flexibility, preservation of the

autonomy of federated entities, predictability

and regularity of transfers and the ability not to

inhibit local collection.

The study of the fundamental themes serves

as a background for the interpretation of the

legal norms pertinent to the matter and for the

solution of conflicts between the federative

entities regarding the distribution of burdens

and the distribution of financial resources.
