SOBERANIA POPULAR E A CRISE REPRESENTATIVA: UMA ANÁLISE DA INEFICÁCIA DO SISTEMA ELEITORAL BASEADO NO SISTEMA PROPORCIONAL E NOS PARTIDOS POLÍTICOS
A conquista dos direitos fundamentais no Brasil se deu ao longo dos anos, se antes o que se tinha era um Estado de Direito, ou seja, as normas estavam positivadas no ordenamento jurídico, garantidas formalmente, hoje se tem um Estado Democrático de Direito, em que as normas possuem real eficácia. Dentro desse contexto, entram os direitos políticos e a soberania popular como fundamento da República Federativa do Brasil, entretanto, a pergunta que se faz é: diante da atual crise, ainda vigora a soberania popular e a democracia? Os representantes estão fazendo as vezes de um Estado Democrático? O objetivo do presente estudo é analisar os conceitos de soberania popular e Estado Democrático de Direito face a atual crise de direito, de forma a averiguar se o papel dos partidos políticos está sendo cumprido, principalmente diante da crise do Direito que está sendo experimentada, discutir também a ineficácia do sistema eleitoral e suas implicações para a sociedade, de forma a verificar quais soluções seriam possíveis para tal problemática. Será aplicado o método dedutivo, que terá cunho qualitativo e explicativo, tendo em vista a finalidade de proporcionar ao leitor a compreensão do fenômeno estudado. A pesquisa será bibliográfica na área de Ciência Política, Direito Constitucional e Direito Eleitoral, através de artigos científicos e notícias pertinentes ao tema

Abstract:
The conquest of fundamental rights in Brazil took place over the years, if what we had before was a rule of law, that is, the rules were positive in the legal system, formally guaranteed, today there is a Democratic State of Law, in which the rules have real effectiveness. Within this context, political rights and popular sovereignty come into play as the foundation of the Federative Republic of Brazil, however, the question is: in the face of the current crisis, does popular sovereignty and democracy still apply? Are the representatives acting as a Democratic State? The objective of this study is to analyze the concepts of popular sovereignty and Democratic Rule of Law in the face of the current crisis of law, in order to ascertain whether the role of political parties is being fulfilled, especially in the face of the crisis of Law that is being experienced, also discuss the ineffectiveness of the electoral system and its implications for society, in order to verify what solutions would be possible for such problem. The deductive method will be applied, which will have a qualitative and explanatory nature, in view of the purpose of providing the reader with an understanding of the phenomenon studied. The research will be bibliographic in the area of Political Science, Constitutional Law and Electoral Law, through scientific articles and news relevant to the topic.
