SIMULAÇÃO E DISSIMULAÇÃO NA PERÍCIA MÉDICA REVISÃO BIBLIOGRÁFICA
A prática da perícia médica, independente da área, está sob constante avaliação e possui uma íntima relação com a judicialização. Nesse contexto, o perito conta com normativas e leis que fundamentam suas atuações e estipulam padrões de diagnósticos, evitando a margem de erro e buscando a abolição da simulação e dissimulação durante a perícia médica. Quanto à avaliação ortopédica, os fatores psicogênicos e reumatológicos, tendo a dor como principal causa da procura médica, tendem a ser grandes geradores de busca pela perícia em saúde. Ainda, cabe ao profissional, de modo a expandir seu padrão de acurácia, aplicar as práticas da semiologia e propedêutica médica integralmente e excludente. Isso se dá, considerando o indivíduo paciente na totalidade, não só um ser limitador de função por uma determinada disfunção fisiológica pontual, mas um ser inserido na sociedade e com essa inserção sendo ou não padrão de doença. Por outro lado, cabe ao profissional a análise documental do paciente, de modo a julgar a possibilidade de fraude, dolosa ou não, e apresentá-las aos setores de fiscalização governamental. Assim, essa revisão bibliográfica dar-se-á apresentar uma fundamentação resumida sobre a simulação e dissimulação na perícia médica, sem deixar de lado que o pior erro médico possível, nesse caso, seria o julgamento de uma simulacro, onde existe de fato uma doença.

Abstract:
The practice of medical expertise, regardless of the area, is under constant evaluation and has an intimate relationship with judicialization. In this context, the expert has regulations and laws that support his actions and stipulate diagnostic standards, avoiding the margin of error and seeking the abolition of simulation and concealment during the medical examination. As for orthopedic evaluation, psychogenic and rheumatological factors, with pain as the main cause of medical search, tend to be great generators of the search for health expertise. Still, it is up to the professional, in order to expand his/her accuracy standard, to apply the practices of semiology and medical propaedeutics integrally and excluding. This happens, considering the patient as a whole, not only a being who limits his function due to a specific physiological dysfunction, but a being inserted in society and with this insertion being or not a pattern of disease. On the other hand, it is up to the professional to analyze the patient's documents, in order to judge the possibility of fraud, whether intentional or not, and present them to government inspection sectors. Thus, this literature review will present a summarized rationale on simulation and dissimulation in medical expertise, without forgetting that the worst possible medical error, in this case, would be the judgment of a simulacrum, where there is in fact a disease.
