SERIA A IMPROBABILIDADE COMUNICACIONAL ENTRE O DIREITO E A CIÊNCIA ACERCA DO RISCO UMA AMEAÇA À GESTÃO RESPONSÁVEL E SUSTENTÁVEL DAS INOVAÇÕES NANOTECNOLÓGICAS?
Se está vivendo um período temporal de grandes transformações, geradas, em parte, pelos avanços científico-tecnológicos. Esse cenário é caracterizado como a Quarta Revolução Industrial e nela se localizam a convergência de diversas tecnologias, dentre as quais se destacam as nanotecnologias. Quanto mais larga for a utilização da nano escala na indústria, maior será a quantidade de produtos colocados à disposição do consumidor. Qual o motivo da preocupação? o avanço das nanotecnologias, num conjunto crescente de aplicações, começa a integrar o cotidiano da sociedade brasileira e mundial. Por outro lado, as pesquisas e os produtos, que advirão desta intervenção humana nas forças naturais, exigirão a atuação dos diferentes sistemas. Em relação ao objetivo, pode-se mencionar a observação da questão da improbabilidade comunicacional entre o sistema do Direito e da Ciência acerca dos riscos nanotecnológicos, bem como o quanto isso afeta a gestão responsável e sustentável da inovação. Desta forma, o problema de pesquisa que se pretende responder pode ser assim definido: sob quais condições o Sistema do Direito, pode lidar com a improbabilidade da comunicação inter-sistêmica entre o Direito e a Ciência, frente ao desafio que os riscos nanotecnológicos representam para a gestão responsável e sustentável da inovação nanotecnológica?Para desenvolver este trabalho utilizou-se a perspectiva metodológica sistêmico-construtivista.

Abstract:
We are living through a period of great transformations, generated, in part, by scientific-technological advances. This scenario is characterized as the Fourth Industrial Revolution and in it are located the convergence of several technologies, among which nanotechnologies stand out. The wider the use of nanoscale in industry, the greater the quantity of products made available to the consumer. What is the reason for concern? the advancement of nanotechnologies, in a growing set of applications, is beginning to integrate the daily life of Brazilian and world society. On the other hand, research and products that will come from this human intervention in natural forces will require the performance of different systems. Regarding the objective, it is possible to mention the observation of the issue of communication improbability between the Law and Science system regarding nanotechnological risks, as well as how this affects the responsible and sustainable management of innovation. In this way, the research problem we intend to answer can be defined as follows: under what conditions the Law System can deal with the improbability of inter-systemic communication between Law and Science, given the challenge that nanotechnological risks pose to responsible and sustainable management of nanotechnological innovation? To develop this work, the systemic-constructivist methodological perspective was used.
