Sentimentos para uma transição: apontamentos sobre o campo jurídico no período monárquico
As práticas jurídicas no Brasil das décadas iniciais do século XIX é um tema que está submetido a análises esporádicas dentro de pesquisas mais amplas sobre a história institucional deste período. Há dificuldades documentais e metodológicas para a compreensão de aspectos cotidianos relacionados com a criação de um novo campo jurídico, que não estava no centro das preocupações iniciais, engolido pelas preocupações políticas e diplomáticas. Uma transição de práticas e valores foi realizada, lentamente, refletindo nas distintas instâncias dos foros, nos interiores e nas poucas cidades onde estavam a maioria dos bacharéis, inicialmente e por muito tempo, todos originários ou associados diretamente à classe dos proprietários. Administração e política se apresentavam com novos limites e autonomia relativa, porém sempre articulados com os poderes tradicionais. Este artigo se propõe a contribuir para o entendimento das articulações transitórias e dos aspectos estruturais que regeram as relações dialéticas entre jurídico e político na construção da nação brasileira.

Abstract:
Legal practices in Brazil in the early decades of the 19th century are subject to sporadic analysis within broader research on the institutional history of this period. There are documental and methodological difficulties in understanding everyday aspects related to the creation of a new legal field, which was not at the center of initial concerns, swallowed up by political and diplomatic concerns. A transition of practices and values was carried out, slowly, reflected in the different instances of the forums, in the countryside and in the few cities where most of the bachelors were, initially and for a long time, all originating or directly associated with the class of owners. Administration and politics presented themselves with new limits and relative autonomy, but always articulated with the traditional powers. This article aims to contribute to the understanding of transitory articulations and structural aspects that governed the dialectical relations between legal and political in the construction of the Brazilian nation.
