O novo sistema processual brasileiro
prevê atividade jurisdicional com conteúdo
principiológico e a busca da interpretação
unificada do ordenamento jurídico. O histórico
de pouca preocupação do Estado brasileiro com
a inclusão social e participação democrática,
faz com que se passe a investigar se os juízes
irão se dispor ou estarão tecnicamente aptos
a decidir dentro das diretrizes e limites que o
exercício da função irá compreender. O perfil
estatal centralizador e autoritário em oposição
à demanda por justiça, poderá criar um ativismo
incontrolável ou mesmo a rebeldia em face
do novo sistema, caso se mostre uma via
incontornável ao conservadorismo.

Abstract:
The new Brazilian legal system
provides for judicial activity with principle-based
content and the search for a unified interpretation
of the law. The history of the Brazilian State, which
has shown little concern for social inclusion and
democratic participation, makes it necessary
to investigate whether judges will be disposed
or technically able to take decisions within the
guidelines and limits which the exercise of
their function demands. The centralized and
authoritarian state system, with a profile opposed
to the demand for justice, may give rise to
uncontrollable activism or even rebellion when
faced with the new system, should this be seen
as unacceptable to the existing conservatism.
