REVISTA VEXATÓRIA NOS PRESÍDIOS
A presente pesquisa fará uma abordagem acerca da revista vexatória nos presídios.
Parte-se de que a revista íntima de parentes de presos fere frontalmente o direito à
intimidade, tendo em vista, haver vários métodos práticos e disponíveis ao Estado para conferir a segurança de um estabelecimento prisional, sem a necessidade de se ter contato íntimo com a pessoa a ser revisada.Com o advento da Lei de Execuções Penais, os presos adquiriram inúmeros direitos, inclusive o de livre visitação por parte do cônjuge, companheira, parentes e amigos, em dias previamente determinados pela administração prisional. Tais visitas surgiram com a intenção de contribuir para recuperação do detento, além do intuito de amenizar a solidão carcerária, visto que a presença da família e de pessoas queridas junto ao preso é absolutamente necessária para alcançar sua ressocialização. O objetivo deste estudo pauta-se em uma
abordagem acerca do sistema carcerário brasileiro e a segurança nas visitas, uma análise sobre a revista vexatória e os princípios constitucionais violados e estudar a forma de conciliar a segurança nos presídios e o direito de visitas dignas. A problemática da presente pesquisa se pauta na seguinte indagação: como conciliar a segurança nos presídios e o direito de visitas dignas? Para a realização desta pesquisa serão utilizadas fontes bibliográficas e documentais, a partir de outros estudos realizados e documentos que já discorrem sobre o tema. A delimitação do tema origina-se do raciocínio metodológico dedutivo, em que se verifica a necessidade de os Estados adotarem as medidas necessárias à adequação de seus protocolos de ingresso em presídios, considerando-se como protocolo geral o controle mecânico/tecnológico.

Abstract:
This research will approach the vexatious search in prisons. It is based on the fact that the intimate search of relatives of prisoners directly violates the right to privacy, in view of the fact that there are several practical and available methods to the State to ensure the safety of a prison establishment, without the need to have intimate contact with the prison. person to be reviewed. With the advent of the Criminal Executions Law, prisoners acquired numerous rights, including free visitation by their spouse, partner, relatives and friends, on days previously determined by the prison administration. Such visits arose with the intention of contributing to the detainee's recovery, in addition to alleviating prison solitude, since the presence of family and loved ones with the prisoner is absolutely necessary to achieve their re-socialization. The objective of this study is based on an approach about the Brazilian prison system and security in visits, an analysis of the vexing journal and the constitutional principles violated and to study how to reconcile security in prisons and the right of dignified visits. The problem of this research is based on the following question: how to reconcile security in prisons and the right to dignified visits? To carry out this research, bibliographical and documentary sources will be used, based on other studies and documents that already discuss the topic. The delimitation of the theme originates from the deductive methodological reasoning, in which there is a need for States to adopt the necessary measures to adapt their protocols for admission to prisons, considering mechanical / technological control as the general protocol.
