RESPONSABILIDADE CIVIL MÉDICA E O TERMO DE CONSENTIMENTO LIVRE E ESCLARECIDO
O consentimento informado diz respeito ao direito de o paciente compreender a situação de sua saúde, os procedimentos propostos, os benefícios, os riscos e a que possíveis consequências pode se submeter antes da realização dos mais variados procedimentos médicos disponíveis. Esse ato é fundamental em prol da autonomia do paciente, além de comprovar a boa-fé do médico, pautado nos princípios éticos. O estudo avaliará os parâmetros de feitura desse termo por escrito e em que medida sua utilização auxilia o médico durante a apuração de sua responsabilidade civil. Desse modo, busca-se estudar os elementos do consentimento informado, do instituto da responsabilidade civil no Brasil para, enfim, compreender-se os termos da responsabilidade civil do médico, elementos cujo conhecimento é indispensável para a prática médica. Para isso, serão utilizados como referenciais teóricos o autor Orlando Gomes e as resoluções administrativas do Conselho Federal de Medicina (CFM). Quanto à metodologia, utiliza-se a vertente jurídico-teórica com raciocínio dedutivo para realizar essa investigação de tipo jurídico-descritivo.

Abstract:
Informed consent is the right that the patient has to understand his health situation, the proposed procedures, the benefits and the risks, as well as to which consequences he may have to go through before he is submitted to one of the many available medical procedures. This action is essential to guarantee the patient’s autonomy, in addition to prove the physician’s bona fide, guided by ethical principles. The study will analyze the guidelines to fabric such forms and how their use can help in establishing the doctor’s civil liability. Therefore, this work aims to study informed consent elements and the Brazilian institute of civil liability in order to, finally, understand the terms of medical civil liability in Brazil, elements which knowledge is indispensible to medical procedures. In order to do so, there will be used as theoretical frame of reference the author Orlando Gomes and CFM’s administrative resolutions. Concerning the methodology, it will be used legal-theoretical theory along with deductive reasoning to conduct this legal-descriptive investigation.
