Abstract: The research aims to demonstrate, argue, and conduct a critical study on the civil liability of the judge as the primary individual responsible for the jurisdictional function and the role of the State within the Judiciary. To facilitate this, an exposition is provided based on the current legislation in the country concerning the concept of civil liability and its practical application. In summary, the research initially addresses the broader field of forensics to introduce the subject matter to those unfamiliar with legal terminology. Subsequently, the study delves deeply into the civil liability of the State. This includes scenarios in which legal entities governed by public law and private entities that provide public services are accountable for the damages caused by their agents to third parties. Specifically, when these agents behave in a commissive or omissive manner, whether legally or materially. Later, the functions, guarantees, rights, and duties, as well as the responsibilities of the director, are briefly discussed. And, finally, the connection between the civil liability of the judge and the State, along with considerations of guilt and intent, is explained. It is important to highlight that the project is developed based on historical, legal, and social notions, aiming for a critical conception of the civil liability of the judge and the State and the true impact of its application or lack thereof in brazilian society.
