REGULAMENTAÇÃO DE CRIPTOATIVOS: UM PANORAMA DO ARCABOUÇO REGULATÓRIO BRASILEIRO PARA O ATUAL CENÁRIO CRIPTOECONÔMICO.
A adaptação do direito às complexidades sociais sempre foi sua premissa básica. Dentro da temática do direito digital, os criptoativos chegaram aos ordenamentos jurídicos sem sobreaviso, sem qualquer regulação. Nesse contexto, o objetivo deste artigo é apresentar a atual situação regulatória dos criptoativos no mundo, com enfoque no cenário criptoeconômico brasileiro, além de, na medida do possível, analisar a viabilidade de implementação do sandbox regulatório. Notou-se, por conseguinte, que o Brasil apresenta um arcabouço regulatório robusto em desenvolvimento e legislações tributárias redigidas de forma a receber da forma em que estão os criptoativos, além de ter o sandbox como instrumento regulatório alternativo pronto para utilização. Dessa forma, o Brasil se apresenta como um país prestes a subir ao nível dos países com regulamentações completas, ao lado da Ilha de Malta e da Singapura. Tais resultados permitem perceber promissor o cenário criptoeconômico brasileiro, cujas discussões inevitavelmente continuarão, e fomentar o debate no âmbito acadêmico e profissional, contribuindo com o avanço inexorável do direito digital.

Abstract:
Adapting the law to social complexities has always been its basic premise. Within the thematic of digital law, cryptography reached the legal systems without warning, without any regulation. In this context, the objective of this article is to present the current regulatory situation of crypto assets in the world, focusing on the Brazilian crypto-economic scenario, in addition to, as far as possible, analyzing the feasibility of implementing the regulatory sandbox. It was noted, therefore, that Brazil has a robust regulatory framework under development and tax laws written in order to receive the form in which crypto are, in addition to having the sandbox as an alternative regulatory instrument ready for use. In this way, Brazil presents itself as a country about to rise to the level of countries with complete regulations, alongside the Island of Malta and Singapore. These results allow us to perceive the Brazilian crypto-economic scenario as promising, whose discussions will inevitably continue, and to foster debate in the academic and professional fields, contributing to the inexorable advance of digital law.
