REFORMA TRABALHISTA À LUZ DA CONVENÇÃO N.º 98 DA ORGANIZAÇÃO INTERNACIONAL DO TRABALHO E SEUS IMPACTOS AOS DIREITOS HUMANOS
Através da Reforma Trabalhista, instrumentalizada pela lei n.º 13.467 de 13 de julho de 2017, o Brasil acaba de passar por profundas alterações no ordenamento jurídico, no que tange a regulamentação das relações trabalhistas, sendo tema recorrente no cenário nacional, sobretudo no tocante as irregularidades encontradas na nova legislação. Nesse ínterim, o presente manuscrito pretende expor o assunto, de maneira sucinta, abordando o tema em suas principais questões, tanto no que concerne a alteração, criação ou revogação de mais de cem artigos da Consolidação das Leis Trabalhistas (CLT), como também na perspectiva das transgressões, tendo como ponto basilar de contestação o descumprimento, pelas novas regras trabalhistas, da Convenção n.º 98 da Organização Internacional do Trabalho (OIT), da qual o Brasil é signatário. Nessa conjuntura, foi utilizado o método dedutivo e pesquisa documental e bibliográfica, a fim de identificar os principais pontos em que apresenta vícios e fomentar o debate no que se refere aos seus impactos nos Direitos Humanos e cidadania do trabalhador, pretende-se ainda, avaliar as transformações da recente legislação de maneira a permitir que se extraia uma visão geral sobre a Reforma Trabalhista.

Abstract:
Through the Labor Reform, instrumentalized by Law n.º 13.467 of July 13, 2017, Brazil has just undergone profound changes in the legal system, with regard to the regulation of labor relations, being a recurring theme in the national scenario, especially with regard to irregularities found in the new legislation. In the meantime, the present summary intends to expose the subject, in a succinct way, addressing the theme in its main questions, both with regard to the alteration, creation or revocation of more than one hundred articles of the Consolidation of Labor Laws, as well as in perspective of transgressions, having as a basic point of contestation the non-compliance, by the new labor rules, with Convention n.º 98 of the International Labor Organization (ILO), to which Brazil is a signatory. At this juncture, the deductive method and documentary and bibliographic research were used, in order to identify the main points in which it presents vices and to foster debate regarding its impacts on Human Rights and workers' citizenship, it is also intended to evaluate the transformations of the recent legislation in order to provide an overview of Labor Reform.
