REFLEXOS DO MOVIMENTO EM REDE #METOO NA FORMAÇÃO DA CONVENÇÃO 190 DA ORGANIZAÇÃO INTERNACIONAL DO TRABALHO
A presente pesquisa, partindo da
recentíssima aprovação da Convenção n° 190
da Organização Internacional do Trabalho pela
108ª Conferência Internacional do Trabalho,
objetiva examinar o arcabouço existente
no ordenamento jurídico brasileiro acerca
do assédio sexual nas relações laborais, e
desvendar em que medida o ativismo digital
traduzido na campanha internacional #MeToo
contribuiu para impulsionar a criação da referida
norma de Direito Internacional. Empregando-se
a técnica de pesquisa bibliográfica, analisam-se
os contornos básicos do assédio no ambiente
laboral e da construção dos movimentos
em rede. Ainda, por meio de procedimento
monográfico, examina-se o caso concreto do
movimento ora referido, bem como o processo
de construção da aludida Convenção. Adotandose o método de abordagem dedutivo, em um
primeiro momento dissecam-se os aspectos
conceituais sobre o tema ligado ao Direito
do Trabalho e, em segunda parte, detalhase brevemente a evolução dos movimentos
sociais perfectibilizados com o uso da Internet,
culminando no estudo da progressão do
movimento #MeToo e da sua tomada pela
OIT. Afere-se, assim, que o movimento digital
contribuiu para a formulação da Convenção
sobre tema nunca antes tratado sob essa ótica.

Abstract:
The present research, based on
the very recent approval of Convention 190
of the International Labour Organization by
the 108th International Labour Conference,
aims to examine the current framework in
the Brazilian legal system regarding sexual
harassment in work relations, and to reveal
to what extent cyberactivism displayed on the
#MeToo international campaign contributed to
the creation of this International Law regulation.
Using the bibliographic research technique, it
analyzes the basic concepts of harassment in
the workplace and of the formation of online
movements. Also, through the monographic
procedure, it analyzes the precise case of
the mentioned movement, as well as the
construction process of the Convention 190. Adopting the deductive approach method, the research at first dissects the conceptual
aspects on the subject linked to Labour Law and, in the second part, briefly details the
evolution of social movements refined with the use of internet, culminating in the study
of the breakthrough of the #MeToo movement and its adoption by ILO. Thus, it finds
that the online movement contributed to the formulation of the Convention on a subject
never treated before from this perspective
