Abstract: This research aims to analyze the effects that a subsequent criminal conviction may have on a federal public servant who has already obtained a favorable decision in the administrative sphere. Considering that, after an administrative proceeding resulting in acquittal, the servant is exonerated from liability, this article investigates the administrative consequences of a later criminal conviction, once the administrative decision has become final. Specifically, it examines whether the criminal jurisdiction has the power to retroactively alter an administrative judgment, potentially invalidating an acquittal and leading to dismissal from public service. The methodology combines a theoretical approach grounded in legal doctrine, literature review, legislative analysis, and case law examination, with a particular focus on Federal Public Administration Law (Law No. 8.112/1990). The study seeks to clarify whether a subsequent criminal conviction can retroactively worsen a final administrative decision.
