REFLEXÕES TEÓRICAS E ANÁLISE CRÍTICA SOBRE A PESQUISA EM HISTÓRIA DO DIREITO
Este artigo apresenta e debate de forma crítica os instrumentos teórico-metodológicos utilizados no desenvolvimento da dissertação de Mestrado defendida em fevereiro de 2018, sob o título: “Vossa Majestade Imperial, porém, decidirá o mais justo”: um olhar sobre clemência imperial e condenação de escravos à morte no Brasil (1853-1878). Trabalhando com a estrutura da dissertação, o estudo faz uma reflexão crítica a respeito da pesquisa em história e em história do direito, considerando as implicações da área e as fragilidades da temática, bem como destacando a necessidade de apresentação clara das orientações metodológicas seguidas para a concretização dos objetivos. Por fim, apresenta uma análise panorâmica das orientações metodológicas que guiaram o desenvolvimento da pesquisa.

Abstract:
This article present and critically discuss the theoretical and methodological instruments used in the development of the master's dissertation defended in February 2018, under the title: “Your Imperial Majesty, however, will decide the most fair”: a look at imperial clemency and the condemnation of slaves to death in Brazil (1853-1878). Working with the structure of the dissertation, the study makes a critical reflection on research in history and in the history of law, considering the implications of the area and the weaknesses of the theme, as well as highlighting the need for a clear presentation of the methodological guidelines followed for the achievement of objectives. Finally, it presents a panoramic analysis of the methodological orientations that guided the development of the research.
