Reflexões sobre a revogada lei de Segurança Nacional e o Estado Democrático de Direito/EDD

Abstract: In 2023, Brazil witnessed invasions and depredations in the country's capital that took place in the National Congress, in the Presidential Palace and in the STF (Federal Supreme Court), raising some questions related to the security of the three branches of government, the laws protecting Brazilian democracy and property, and mainly the protection of the Democratic State of Law. Various media channels broadcasted live scenes of invasions and depredations, scenes that ended up having repercussions in the country as well as in the international press. As a first reaction, we had the determination of a federal intervention in the Federal District, in the scope of public security, with the objective of containing “serious impairment of public order”. This article analyzes the revoked National Security law created during the Brazilian dictatorship, as well as the reflection of its historical context of birth and evolution, tracing to the present day, indicating the reasons that led to its revocation by the 14197/2021 Law. It also proposes to carry out an analysis of the 14197/2021 Law, which, in addition to repealing the LSN, created a new title for the Penal Code “On crimes against the Democratic State of Law” and new types of criminal offenses. Finally, it reflects on the Democratic State of Law and the current risks.
