RECONHECIMENTO E FEMINISMOS: A LUTA PELA EFETIVIDADE DOS DIREITOS DAS MULHERES
O presente artigo se propõe a
investigar as demandas por reconhecimento
empreendidas pelos movimentos feministas
contemporâneos. Na travessia em direção à
reconstrução dos papéis de gênero, outras
diferenças como sexualidade, raça, classe,
geração, entre outros marcadores sociais,
devem ser consideradas. A hipótese da qual
partiu este artigo é: em que medida as lutas
feministas por reconhecimento afetam a
efetividade dos direitos humanos hoje, em
particular no Brasil. O exame do direito e,
em especial, dos direitos humanos sob uma
lente de gênero, implica investigar os déficits
de igualdade e justiça. Os desafios da luta
feminista, a efetividade dos direitos humanos
e a consolidação da democracia no Brasil se
encontram neste estudo. Tratar do feminino
no espaço público democrático implica
reconhecimento e interseccionalidade. Desde
as primeiras demandas públicas das mulheres
até a contemporaneidade, a luta pelos direitos
das mulheres tem sido contínua. No campo do
direito, a análise de discursos jurídicos sob uma
lente pós-feminista reconhece a linguagem
jurídica como um lugar de constante luta política.
O feminismo e os direitos das mulheres têm
conquistado um espaço determinante na agenda
pública e fomentado a construção de uma nova
concepção de cidadania. No âmbito dos direitos
humanos, os discursos do Estado brasileiro
colidem com suas práticas. Enquanto na esfera
internacional o país ratificou e se comprometeu
perante diversas normas internacionais de
direitos humanos, internamente tem promovido
cada vez mais práticas heterogêneas e
contraditórias, violadoras de direitos humanos.

Abstract:
This paper aims to investigate
the demands for recognition undertaken by
contemporary feminist movements. In the
transition towards the reconstruction of gender
roles, other differences such as sexuality,
race, class, generation, among other social
markers, should be considered. The hypothesis
from which this paper commenced is: to what
extent feminist recognition struggles affect the
effectiveness of human rights today, particularly
in Brazil. Examining law, and in particular
human rights from a gender perspective,
involves investigating deficits in equality and justice. The challenges of the feminist struggle, the effectiveness of human rights and
the consolidation of democracy in Brazil are aligned in this study. Dealing with the
feminine in the democratic public space implies recognition and intersectionality. From
the first public demands of women to contemporary times, the struggle for women’s
rights has been continuous. In the field of law, the analysis of legal discourses from a
post-feminist lens recognizes legal language as a place of constant political struggle.
Feminism and women’s rights have gained a decisive place in the public agenda and
fostered the construction of a new conception of citizenship. In the field of human rights,
the discourses of the Brazilian state clash with its practices. While in the international
sphere the country has ratified and committed itself to various international human rights
norms, internally it has promoted more and more heterogeneous and contradictory
human rights violating practices.
