QUANDO O PROBLEMA ESTÁ NO NOME: O DIREITO À RETIFICAÇÃO DO REGISTRO CIVIL DA COMUNIDADE TRANSGÊNERO BRASILEIRA
O presente artigo busca analisar a evolução da jurisprudência do Supremo Tribunal Federal e Superior Tribunal de Justiça acerca do direito à retificação do registro civil da comunidade transgênero brasileira. Se faz valer da análise de acórdãos e, especialmente no caso da ADI 4.275/15, dos votos dos ministros e manifestações dos amici curiae, além de levantamento bibliográfico, para compor o estudo. Discute o conceito de democracia que transparece dos julgados, tendo em vista o papel cumprido pelo instituto jurídico amicus curiae e a função contramajoritária exercida pelas cortes superiores.

Abstract:
This article analise the evolution of the jurisprudence of the Supreme Federal Court and Superior Court of Justice about the right to rectification of the civil registry of the brazilian transgender community. It uses the analysis of the decisions and, specially in the case of the ADI 4.275/15, votes of the ministers and manifestations of the amici curiae, in addition to bibliographic survey, to compose the study. Discusses the concept of democracy that transpires off the decisions, taking in account the part played by the legal institute amicus curiae and the countermajority function exercised by the superior courts.
