Abstract: Depending on human memory, personal recognition is a type of evidence regulated by article 226 of the Brazilian Code of Criminal Procedure. Understood for a long time as “mere recommendations”, the procedures expressed in this article guarantee the rights of the citizen under investigation, a guarantee that has been affirmed thanks to advances in jurisprudence, combined with legal doctrine and psychology. The analysis proposed in this work evaluates how the doctrine has behaved in relation to what is proposed in art. 226 of the CPP and then ponders the changes in case law, especially those of the Superior Court of Justice, and points to new perspectives for improving the process of recognition in criminal proceedings.
