Abstract: “ne bis in idem or non bis in idem” is one of the basic principles of law, not only Brazilian law, but also found in international treaties ratified by countless other countries, always bringing the concept that no one can be judged more than than once for committing the same crime. With this we will present an impact on both criminal procedural law and constitutional law, in which Brazil is a signatory, all with the same purpose of not being convicted twice for the same fact. There are those who argue that if you want to be prosecuted for the same fact for which you were convicted in a final and res judicata sentence, this also applies to cases of acquittal. In the research, the inductive method was used, based on literature relevant to the topic, this work also has the function explanatory by dissecting and bringing to knowledge the concepts highlighted by the doctrine referring to the title of the work.
