PRECEDENTES: INSTRUMENTOS FUNDAMENTADOS NA COERÊNCIA IMPERATIVA DA CONCRETIZAÇÃO JUSFUNDAMENTAL DA SEGURANÇA JURÍDICA E DA IGUALDADE
Por meio da revisão da legislação e doutrina, utilizando o método dedutivo, o presente estudo busca analisar precisamente a relação existente entre a efetivação dos direitos fundamentais à segurança jurídica e igualdade e a preocupação atinente aos precedentes e a fundamental crença no requisito da coerência. Nesse sentido, houve a identificação precípua da necessidade conceitual de existência de instrumentos para a harmonização da jurisprudência, aos moldes do que definiu o artigo 926 do Código de Processo Civil de 2015, mantendo-a estável, íntegra e coerente dentro de um sistema jurídico. Por derradeiro, analisar-se-á de que formas os precedentes, sejam obrigatórios ou persuasivos, concretizam os objetivos traçados pelo legislador e garantem, ao menos conceitualmente, as necessárias e imperativas segurança jurídica, integridade, coerência e igualdade que fundamentam os sistemas judiciais dos Estados Democráticos de Direito.

Abstract:
Through the revision of legislation as well as the doctrine, using the deductive method, the present study seeks to analyze precisely the relationship between the realization of fundamental rights to legal certainty and equality and the preoccupation with precedents, and his grounding belief in the requirement of coherence. In this sense, the primary identification of the conceptual need for the existence of instruments for the harmonization of jurisprudence, as defined in Article 926 of the 2015 Code of Civil Procedure, keeping it stable, integrate and coherent within a legal system. At last, it will examine in what ways the precedents, in both their forms, whether mandatory or persuasive, achieve the objectives set by the legislator and guarantee, at least conceptually, the necessary and imperative legal certainty, integrity, coherence and equality, which underlie the judicial systems of the democratic rule of law.
