POSSIBILIDADES DO USO DAS OPERAÇÕES URBANAS CONSORCIADAS COMO INSTRUMENTO DE REGULARIZAÇÃO URBANÍSTICA: O CASO DE BELO HORIZONTE
Alguns instrumentos de política
urbana merecem um estudo mais aprofundado.
Dentre eles, destaca-se a Operação Urbana
Consorciada. Após décadas da aprovação da
lei denominada Estatuto da Cidade, a qual
regulamentou esse instrumento, verifica-se a
oportunidade de ampliar as reflexões sobre a
implantação e implementação das Operações
Urbanas no Brasil. Em Belo Horizonte, esse
instrumento, vem sendo aplicado desde o final
do Século passado. Este artigo apresenta
parte dos resultados de uma pesquisa
sobre a utilização das Operações Urbanas
Consorciadas na capital de Minas Gerais,
envolvendo os campos da Arquitetura e do
Direito. Como recorte de estudo, pretende-se
investigar, baseado em estudos de renomados
autores do Direito Urbanístico a eficácia ou
ineficácia da aplicação das Operações Urbanas
como instrumento de regularização urbanística,
bem como, se está ocorrendo sua utilização
sem desvios de finalidade na cidade. Estudouse
especificamente a Operação Urbana do
Conjunto da Avenida Oiapoque que teve
significativo impacto urbano e social na cidade,
neste Século. Para realização do artigo utilizou
dados disponibilizados em órgãos municipais
e uma extensa revisão bibliográfica. No final
conclui-se que em Belo Horizonte, apesar de
avanços, as legislações pertinentes ao tema
abrem inúmeras possibilidades de negociação
entre o Poder Público e a iniciativa privada, o que
pode acarretar a determinação de contrapartidas
afastadas dos reais interesses públicos, além
do inadequado uso do instrumento, com o
objetivo de transgredir diretrizes do Plano
Diretor da cidade. Entretanto, com relação a
regularização urbanística, pode-se tornar um
eficaz instrumento de política urbana.

Abstract:
Some urban policy instruments
deserve further study. Among them, the
Urban Consortium Operation stands out. After
decades of approval of the Statute of the City,
which regulated this instrument, there is an
opportunity to expand the reflections on the
implementation and implementation of Urban
Operations in Brazil. In Belo Horizonte, this
instrument has been applied since the end
of the last century. This article presents part
of the results of a research on the use of the
Consortium Urban Operations in the capital of Minas Gerais, involving the fields of
Architecture and Law. As a study cut, we intend to investigate, based on studies of
renowned authors of Urban Law, the effectiveness or inefficiency of the application
of Urban Operations as a tool for urbanization regularization, as well as whether its
use is occurring without detours of purpose in the city. It was specifically studied the
Urban Operation of the Oiapoque Avenue Complex that had a significant urban and
social impact on the city in this Century. For the accomplishment of the article it used
data made available in municipal organs and an extensive bibliographical revision. In
the end, it is concluded that in Belo Horizonte, in spite of advances, the legislations
pertinent to the subject open numerous possibilities of negotiation between the Public
Power and the private initiative, which may entail the determination of counterparts
away from the real public interests, besides the inadequate use of the instrument, with
the purpose of violating directives of the Master Plan of the city. However, with regard
to urbanization regularization, it can become an effective instrument of urban policy.
