POSSIBILIDADE DE ADOÇÃO POR CASAIS HOMOAFETIVOS: CONSAGRAÇÃO DO AMOR COMO LEI SOCIAL À LUZ DA JURISPRUDÊNCIA BRASILEIRA
O artigo em comento tem como intuito apresentar a aplicação da adoção realizada por casais homoafetivos. Inicialmente, este trabalho tem como escopo mostrar a importância do Estado em zelar pela excelência das crianças e dos adolescentes, analisar a possibilidade do reconhecimento jurídico da adoção por casais homoafetivos no ordenamento jurídico atual, em virtude da omissão da lei com relação ao tema. Com base na doutrina e jurisprudência será demonstrado que é fundamental o zelo pelo adotando, com o enfoque voltado para os princípios da proteção integral, da afetividade e do melhor interesse do menor. Importante destacar que o estudo apresentado possui relevância não só acadêmica, mas social, pois tal modalidade de adoção vem sendo aplicada no ordenamento jurídico brasileiro mesmo com a lacuna legal, de modo que atualmente há a consagração do amor como lei social.

Abstract:
The article in question aims to present the application of adoption carried out by homosexual couples. Initially, this work aims to show the importance of the State to ensure the excellence of children and adolescents, to analyze the possibility of legal recognition of adoption by homosexual couples in the current legal system, due to the omission of the law on the subject. Based on doctrine and jurisprudence, it will be demonstrated that zeal for the adopting is fundamental, with a focus on the principles of integral protection, affection and the best interest of the minor. It is important to highlight that the study presented has not only academic, but social relevance, as this type of adoption has been applied in the Brazilian legal system even with the legal gap, so that there is currently the consecration of love as a social law.
