POPULAÇÃO LGBT E O DIREITO À SAÚDE: ESTRATÉGIAS DECOLONIAIS DA MILITÂNCIA TRANS JUNTO À PREVENÇÃO COMBINADA DAS IST/HIV/AIDS E DESIGUALDADES NO ACESSO ÀS POLÍTICAS PÚBLICAS NA 12ª JORNADA LGBT DE PICOS-PI
Esta comunicação nasce da
demanda de experiências acadêmicas em
diálogo com os saberes locais exigidas pela
disciplina Antropologia Jurídica e formação
profissional no curso de Direito em uma
faculdade no interior do Piauí. Justificando-se
na relevância social e científica da produção
de conhecimento acerca das culturas
democráticas e diversas práticas de resistência
étnico-racial junto ao direito à saúde e acesso
às políticas públicas, adotou-se como objeto
de estudo as estratégias da militância trans
empreendidas na 12ª Jornada LGBT na cidade
de Picos. Tendo como objetivo a análise crítica
dos discursos afirmativos acerca do direito
da população LGBT enquanto expressão do
pensamento decolonial. Os resultados apontam
a transgressão das linguagens corporais, orais
e escritas como estratégias étnico-raciais frente
às opressões cotidianas que negam os direitos
fundamentais e reproduzem atendimentos
discriminatórios por parte dos profissionais
e agentes de saúde nas unidades do serviço
público. Se desde a constituição de 88 o direito
à saúde é dever do Estado, visto como Direito
Universal e Igualitário independente do sexo,
raça ou etnia, verificou-se que os discursos
conservadores negam a constitucionalidade
das políticas para a diversidade de gênero e
sexualidade. Conclui-se que a Jornada LGBT
na cidade de Picos tem proporcionado um
intercâmbio estratégico entre saberes locais
da militância trans no Nordeste brasileiro, tal
como reação aos retrocessos e negações dos
direitos fundamentais da população LGBT junto
ao Sistema Único de Saúde (SUS) e demais
políticas públicas (MAFRA, 2015).

Abstract:
This communication is born from the demand of academic experiences
in dialogue with the local knowledge required by the Legal Anthropology discipline and
professional formation in the Law course at a college in Piauí. Justifying in the social
and scientific relevance of the production of knowledge about democratic cultures
and diverse practices of ethnic-racial resistance to the right to health and access to
public policies, the strategies of trans activism undertaken in the 12th were adopted as
object of study. LGBT day in the city of Picos. Having as objective the critical analysis
of affirmative discourses about the right of the LGBT population as an expression of
decolonial thought. The results point to the transgression of body, oral and written
languages as ethnic-racial strategies in face of daily oppressions that deny fundamental
rights and reproduce discriminatory care by health professionals and agents in public
service units. If since the constitution of 88 the right to health has been a duty of the
State, seen as Universal and Equal Law independent of gender, race or ethnicity, it
has been found that conservative discourses deny the constitutionality of policies for
gender diversity and sexuality. It is concluded that the LGBT Day in the city of Picos
has provided a strategic exchange between local knowledge of trans activism in the
Northeast of Brazil, as a reaction to the setbacks and denials of the fundamental rights
of the LGBT population within the Unified Health System (SUS) and others. public
