POLÍTICAS PÚBLICAS DE SEGURIDADE SOCIAL: A NECESSIDADE DE AMPLIAÇÃO DA PROTEÇÃO SOCIAL COMO FORMA DE CONCRETIZAÇÃO DOS DIREITOS HUMANOS
O presente trabalho tem por objetivo
ressaltar a importância da criação do Auxílio-
Doença Parental, face a inexistência de proteção
a este risco social que afeta a dignidade da
pessoa humana, uma vez que atinge direito
fundamental ao trabalho e a proteção integral
da criança, ambos assegurados expressamente
pela atual Constituição Federal. A problemática
consiste em demonstrar qual a importância
da criação do benefício previdenciário de
Auxílio-Doença Parental na efetivação dos
direitos humanos, como uma política pública
de Seguridade Social. Para tanto, inicialmente
discorreu-se sobre as conquistas dos direitos
humanos, em especial dos direitos humanos
de segunda geração cujo direito à seguridade
social, destacado pela previdência está inserido.
Posteriormente, foi abordado o conceito do
benefício previdenciário de Auxílio-Doença
Parental e estabelecido uma comparação com
o Auxílio-Doença propriamente dito. Por fim,
demonstrou-se o risco social envolvido ante a
falta de regulamentação legal no Regime Geral
da Previdência Social.

Abstract:
The present essay tries to present
the importance of the creation of the Parental Aid-
Disease as a form of realization of the Human
Rights as Public Policy of Social Security, due
to the lack of protection to this social risk that
affects the dignity of the human person, since it
reaches right fundamental to the work and the
integral protection of the child, both expressly
assured by the current Federal Constitution.
In order to do so, the concept and evolution of
human rights was initially discussed, seeking
to establish a connection between second
generation of human rights and the social
security system. Subsequently, the concept
of the social security benefit discussed in this
research and a comparison with the Sickness
Aid itself was approached. Finally, the social
risk involved in the lack of legal regulation in the General Social Security System was
demonstrated.
