POLÍTICAS DE PROTEÇÃO E O PAPEL DOS DEFENSORES DE DIREITOS HUMANOS: O CASO MANOEL MATTOS
A defesa dos direitos humanos vai
além da atuação do Estado, sendo importante
a participação da sociedade para salvaguardar
os direitos fundamentais inerentes à dignidade
humana, como através da atuação dos
defensores de direitos humanos. Entretanto,
verificam-se ameaças à continuidade das lutas
emancipatórias nas quais os defensores estão
envolvidos, se encontrando, muitas vezes,
isolados e sem recursos ou qualquer proteção
oferecida pelo Estado. Seguindo a Declaração
da ONU sobre defensores dos direitos humanos
(1998), ressalte-se a evolução na instituição de
políticas de proteção no Brasil, notadamente:
Programa de Proteção aos Defensores de
Direitos Humanos-PPDDH (2004), Política
Nacional de Proteção aos Defensores de
Direitos Humanos (2007) e seu Comitê Brasileiro
de Defensores de Direitos Humanos. Por outro
lado, a ausência do Estado para execução
dessas políticas públicas cede espaço para a
atuação de milícias. Nesse contexto, este artigo
abordará, por meio de pesquisa bibliográfica
e documental, os limites das políticas de
proteção aos defensores dos direitos humanos
através do caso Manoel Mattos, defensor
dos direitos humanos que, mesmo protegido
por medidas cautelares, foi assassinado em
2009 por denunciar grupos de extermínio que
atuam na divisa de Pernambuco e Paraíba.
Diante da pesquisa realizada, verificou-se
que, embora, em 2018, o PPDDH complete 14
anos de existência, muitas lacunas persistem,
sobretudo diante da falta de marco regulatório,
desarticulação com as autoridades dos Estados
para incorporação dos Direitos Humanos como
política transversal e investigação das ameaças
e crimes para proteção integral dos defensores.

Abstract:
The defense of human rights
goes beyond the State’s actions, and society’s
participation is important to safeguard the
fundamental rights inherent to human dignity,
such as through the actions of human rights
defenders. However, there are threats to the
continuity of the emancipatory struggles in
which the defenders are involved, often finding
themselves isolated and without resources or
any protection offered by the State. Following
the UN Declaration on Human Rights
Defenders (1998), we highlight the evolution
in the institution of protection policies in Brazil,
namely: Protection Program for Human Rights
Defenders-PPDDH (2004), National Policy for
the Protection of Defenders of Human Rights
(2007) and its Brazilian Committee of Human Rights Defenders. On the other hand, the
absence of the State to execute these public policies gives space for militias to act. In
this context, the work will address, through bibliographical and documentary research,
the limits of policies to protect human rights defenders through the Manoel Mattos
case, a human rights defender who, even protected by precautionary measures, was
murdered in 2009 for denouncing extermination groups operating on the Pernambuco
and Paraíba border. In view of the work carried out, it was verified that although in 2018
PPDDH completes 14 years of existence, many gaps persist, especially in the face of a
lack of regulatory framework, disarticulation with State authorities for the incorporation
of Human Rights as a transversal policy and investigation of threats and crimes for the
full protection of defenders.
