Abstract: Disturbing the peace is a minor offense, while noise pollution, characterized by harm to human health, is considered an environmental crime. Both offenses share the same characteristic: sound intensity emitted above acceptable legal levels. However, in police incidents, due to a lack of specialized technical equipment, it is generally not possible to prove the crime of noise pollution, and the offender is only held accountable for the misdemeanor of disturbing the peace. This study, entitled "Disturbing the peace and noise pollution in incidents attended by the PMPA," aims to understand the disparities between two distinct legal concepts: the misdemeanor of disturbing the peace and the crime of noise pollution. The methodology used consisted of a qualitative research procedure based on the legal-dogmatic method of interpretation. Finally, it is necessary to have educational campaigns and public policies aimed at combating noise pollution; however, it is also of utmost importance that the penalties for this type of crime be greater, in order to curb individualistic practices that directly harm the community.
