Abstract: It will analyze the animus – the agent's intention – in crimes against honor, based on some considerations pointed out by Ryle, which oppose Cartesian dualism, as a conception of mind as a scope, as a place parallel to the body. At the beginning, it will establish the importance of the role of philosophy in understanding legal sciences and how the correct application of the term “animus” depends on the assimilation of private language as a paradox. Next, it will briefly address insults and crimes against honor, pointing out some legal definitions that will be useful throughout the text, since the conclusion of the work is that the agent's intention must be examined objectively, that is, that the “conscious self” that can commit the violent act is not an incomprehensible labyrinth, but a practical structure, which assimilates linguistic categories and uses them in the context of language. By structuring such thoughts, language is collective and not private (inaccessible to third parties). The work, therefore, with the animus in crimes against honor as a backdrop, is a philosophical revisitation of Ryle's criticisms of the dogma of the Cartesian “ghost in the machine”. Finally, it will point out, as a suggestion to the legal issue, that the animus be investigated based on strictly objective elements, namely: the philosophical understanding of speech acts, a topic to be addressed in future work.
