OS PRINCÍPIOS PENAIS FUNDAMENTAIS EM CONTRASTE COM A REALIDADE CARCERÁRIA BRASILEIRA
A realidade carcerária brasileira está distante do ideal proposto pelos princípios penais fundamentais, quais sejam: os princípios da legalidade, culpabilidade, proporcionalidade, intervenção penal mínima, ofensividade, humanidade das penas e ressocialização, e pelas garantias estabelecidas na Constituição e em tratados internacionais cujo país é signatário. Ocorre que a observação de tais princípios evidencia-se de fundamental importância para o estabelecimento de um sistema prisional justo e eficaz, condizente com a busca do bem-comum e com os valores da dignidade humana. A aplicação dos princípios denominados fundamentais faz-se necessária. O presente trabalho, baseando-se na pesquisa eminentemente bibliográfica, procura defender a correta observação dos princípios penais fundamentais no sistema prisional brasileiro, já que este deve ser pensado e executado numa perspectiva de bem-estar social e respeito aos indivíduos.

Abstract:
The Brazilian prison reality is far from the ideal proposed by the fundamental penal principles, namely: the principles of legality, culpability, proportionality, minimum penal intervention, offensiveness, humanity of sentences and resocialization, and by the guarantees established in the Constitution and in international treaties whose country is a signatory. It so happens that the observation of such principles proves to be of fundamental importance for the establishment of a fair and effective prison system, consistent with the pursuit of the common good and with the values of human dignity. The application of the so-called fundamental principles is necessary. The present work, based on an eminently bibliographical research, seeks to defend the correct observation of the fundamental penal principles in the Brazilian prison system, since this must be thought and executed in a perspective of social well-being and respect for individuals.
