OS PRECEDENTES DECORRENTES DE REPERCUSSÃO GERAL E RECURSOS REPETITIVOS NA SOLUÇÃO ARBITRAL DOS CONFLITOS
Este artigo se propõe avaliar como os árbitros devem atuar em face dos precedentes
decorrentes de repercussão geral e recursos repetitivos, uma vez que possuem força
vinculante constitucionalmente no poder judiciário. Para tanto, inicialmente será realizado um
panorama histórico dos sistemas jurídicos e conceitos elementares. Na sequência, será
exposto os fundamentos dos doutrinares que defendem a vinculação dos precedentes
advindos de repercussão geral e recurso repetitivo na solução arbitral, bem como a posição
dos doutrinadores que defendem a inexistência de vinculação. Ao final, se demonstrará as
hipóteses de impugnação de sentença arbitral e uma breve solução para questão aqui
abordada. Ademais, o método utilizado foi, majoritariamente, o de análise bibliográfica. Os
objetivos apontados no projeto inicial foram alcançados.

Abstract:
This scientific article aims to evaluate how arbitrators should act in the face of precedents
arising from general repercussion and repetitive appeals, since they have constitutionally
binding force on the judiciary. To this end, initially a historical overview of the legal systems
and elementary concepts will be performed. Next, the doctrinal arguments defending the
binding nature of precedents stemming from general repercussion and repetitive appeals in
the arbitration solution will be presented, as well as the position of those who defend the
inexistence of binding nature. Finally, the hypotheses for challenging an arbitration award and
a brief solution to the issue addressed here will be presented. Furthermore, the method used
was mostly a bibliographical analysis. The goals set out in the initial project were achieved.
