Os fundamentos e origens do Direito
O estudo científico que aqui se apresenta teve por objetivo a aproximação — considerada de extrema urgência — entre a Filosofia do Ser e o Direito; isto é, entre o Direito e uma busca pelo sentido do ser em meio a crise jurídica que se apresenta na atualidade. Para isto, fez-se necessário um aprofundamento inicial nos conceitos basilares da filosofia heideggeriana, seguidos por uma problematização lógica do contexto em que se apresenta a obra do autor, tal como a relação intrínseca de tal conceito com o qual nos encontramos na atualidade. Em seguida, a reflexão da origem do Direito e sua natureza ficcional foram abordadas para, em um próximo momento, estabelecer-se a Justiça — na correlação com o Dasein — como caminho para um existir autêntico do Direito.

Abstract:
The scientific study presented here has the objective of approaching the relation between the Philosophy of Being and the Law; i.e. between law and a search for the meaning of being in the midst of the current legal crisis. For this, it was necessary an initial deepening in the basic concepts of Heideggerian philosophy, followed by a logical problematization of the context in which the author's work is presented, as well as the intrinsic relationship of such concept with which we find ourselves today. Finally, the reflection of the origin of Law and its fictional nature were approached to, in a next moment, establish Justice - in correlation with Dasein - as a way to an authentic existence of Law.
