OS DIREITOS HUMANOS COMO PRODUTOS CULTURAIS: PERSPECTIVAS PARA A EFETIVIDADE DA DIGNIDADE HUMANA
A Declaração Universal de Direitos
Humanos de 1948, bem como a gradual
evolução histórica da humanidade e o
desenvolvimento de sistemas internacionais
de proteção dos direitos humanos, ampliaram
os ordenamentos jurídicos estatais, voltandoos
à garantia de valores universalmente
consagrados e reconhecidos como inerentes
à dignidade da pessoa humana sob a forma
de direitos positivados. Todavia, por vezes,
os costumes praticados por grupos sociais
colidem com esses direitos, como no caso do
Brasil, por exemplo, no que diz respeito às
práticas culturais de algumas tribos indígenas,
o que pode colocar em risco a efetividade da
dignidade humana. O presente estudo, então,
faz uma análise sobre a complexa relação entre
os costumes e os direitos humanos positivados,
considerando a necessidade de integração
e respeito à diversidade cultural existente na
sociedade global diante da salvaguarda desses
direitos, a fim de apontar soluções para a
garantia da proteção e realização da dignidade
humana mediante uma nova interpretação
da teoria do multiculturalismo entendendo os
direitos humanos como produtos culturais.

Abstract:
The Universal Declaration of
Human Rights of 1948, as well as the gradual
historical evolution of humanity and the
development of international systems for the
protection of human rights, have broadened
the state legal systems, restoring them to the
guarantee of universally consecrated values
recognized as inherent to dignity of the human
person in the form of positive rights. Sometimes,
however, customs practiced by social groups
collide with these rights, as in the case of Brazil,
for example, with respect to the cultural practices
of some indigenous tribes, which may jeopardize
the effectiveness of human dignity. This study
analyzes the complex relationship between
customs and human rights, considering the
need for integration and respect for the cultural
diversity existing in the global society in order
to safeguard these rights, in order to identifying
solutions to guarantee protection and realization
of human dignity through a new interpretation of
the theory of multiculturalism by understanding
human rights as cultural products.
