OBSTÁCULOS AO DESENVOLVIMENTO DO REFÚGIO
O refúgio representa o exercício de
um direito de acolhimento após a fuga daquele
que, em seu país, não encontra condições
mínimas de sobrevivência. A universalização
do instituto ocorreu com a Convenção de
1951. Além disso, documentos específicos,
como a Convenção da Organização de
Unidade Africana para Refugiados de 1969,
a Declaração de Cartagena de 1984 e a Lei
brasileira nº 9.474 de 1997, complementaram
a proteção prevista na Convenção de 1951.
A política de refúgio desenvolvida pelo Brasil
revela forte inclinação na direção do modelo
eurocêntrico de tratamento dos refugiados.
Através de construções interpretativas do
ordenamento jurídico, tem se evidenciado a
sujeição do refúgio ao reducionismo de uma
hermenêutica empregada em detrimento do
intuito protetivo do instituto. É preciso romper
com a colonialidade institucional observada no
país e que, através do CONARE, continua a
fazer com que o governo brasileiro reproduza a
leitura eurocêntrica conferida ao refúgio.

Abstract:
The refuge represents the exercise
of a right for being hosted after escaping from
one´s own country for not having the minimum
conditions of survival. The universalization of
the institute occurred with the 1951 Convention.
Furthermore, specific documents, like the
Convention of the Organization of the African
Unit for Refugees from 1969, the Declaration
of Cartagena from 1984 and the Brazilian
Law number 9.474/1997, complemented
the protection predicted in the Convention
from 1951. The policy of refuge developed in
Brazil, revealed strong tendency towards the
Eurocentric model of refugee’s treatment. By
means of the interpretative constructions of the
legal system, it has been evident the subjection
of refuge to the reductionism of a hermeneutics
employed in detriment of the protective intention
of the institute It’s necessary to rupture with the
institutional coloniality observed in the country
and that, through CONARE, continues to make
that the Brazilian government reproduces the
Eurocentric reading in relation to refuge.
