Abstract: One of the greatest challenges to be faced by society in the coming years will be managing the unwanted and excessive number of existing legal processes. The judicialization of conflicts is deeply ingrained in Brazilian culture, posing a major obstacle to national development. It is inconceivable that significant contracts are subject to the resolution of processes that take decades to reach a final decision. This reality hampers private initiatives from making important and necessary investments for the Brazilian population due to a clear lack of legal certainty. Given the situation, the best alternative for contractors is to use extrajudicial conflict resolution mechanisms. Some of these institutions already have consolidated use in Brazil, such as arbitration. A method gaining traction in Brazil in recent years is the use of Dispute Boards, also known as Dispute Resolution Committees. Dispute Boards can be defined as a dispute resolution mechanism involving the formation of a committee of experts in technical matters. They work together to monitor the contractual execution from the beginning, actively preventing and resolving potential conflicts that may arise during the contractual relationship. Dispute Boards are widely used in international public procurement but still have limited use in Brazil. They represent a modern contractual governance tool and are one of the methods for extrajudicial conflict resolution. Their importance has been highlighted recently after the World Bank began requiring their inclusion in contracts for financing concessions. With this work, it is hoped to introduce knowledge about this tool to the universe of regulatory agencies, as it will be essential to ensure national development in the coming years.
