O SUPERENCARCERAMENTO À LUZ DA PERSPECTIVA DA POLÍTICA DE GUERRA ÀS DROGAS: UM RECORTE PUNITIVISTA E SELETIVISTA ACERCA DA PROBLEMÁTICA CONTEMPORÂNEA
A política de “guerra às drogas” marca a atual forma do tratamento oferecido à questão da presente sistemática no modelo brasileiro. É, nesse contexto, delineado pelo amplo tratamento penal e pela redução das liberdades e garantias, que se insere a problemática do superencarceramento. A denominação “guerra-às-drogas”, deriva de fato de uma verdadeira política bélica, inserida em um contexto proibicionista, marcado pela ideologia da segurança nacional e defesa social, que impendem à um sistema penal autoritário, centrado sobretudo na ideia de neutralização de inimigos, estes que são representados na figura dos traficantes. A pesquisa busca, assim, entender, o contexto que se insere essa política de criminalização das substâncias tidas como ilícitas, passando desde o seu principal marco, tido como a influência dos Estados Unidos para a atual Lei 11.343/2006. Nessa senda, pretende-se explicar a solidificação desta política, através da perspectiva da colonização ideológica patrocinada a partir do território norte-americano ao redor do mundo, bem como, busca-se apresentar os principais marcos proibicionistas que corroboram para o atual cenário. A análise do modelo repressivo hodierno, não deve, assim, ser destacado e examinado de forma unidimensional. Nesse sentido, a pesquisa se volta em investigar e entender as perspectivas de reprimendas que ensejaram o hodierno contexto de punição e controle.

Abstract:
The “war on drugs” policy shapes the current treatment given to the issue in the current systematic Brazilian model. It is defined, in this context, by the widespread criminal treatment and by the curtailment of freedoms and guarantees, of which the mass imprisonment problem is a part of. The naming “war on drugs”, takes root in a truly warlike policy, inserted in a prohibitionist context, shaped by the national security and social defense ideologies which belong to a authoritarian criminal system, characterized above all by the idea of taking down enemies, represented, in this instance, by the figure of drug dealers. Thus, this paper intends to understand the context in which this policy of criminalization of so said illegal substances takes place, passing through its main milestone, that being the influence of USA in the current law nº 11.343/2006. Following the same reasoning, it also intends to explain the hardening of said policy, through the perspective of the ideological colonization spearheaded from the American territory to the rest of the world, as well as showing the main prohibitionist milestones which contribute to the current setting. Thus, the analysis of the ongoing repressive system must not be detached and examined unidimensionally. Therefore, this paper focuses on investigating and understanding the perspectives of the reprimands which give cause to the current context of punishment and control
