Abstract: The current classification of non-human animals as objects of law conflicts with social expectations and the principles of a socio-environmental State, hindering the effective enforcement of their constitutional protection. This research argues that anthropocentric environmental ethics, reflected in current laws, fail to ensure adequate protection for non-human animals. It proposes a shift toward ethics grounded in otherness and explores the concept of “depersonalized entities” within Brazilian law as a pathway to classify non-human animals as legal subjects. Using the deductive method, alongside bibliographic review, case law analysis, and legislative consultation, this study concludes that adopting an ethical standard based on otherness and recognizing non-human animals as legal subjects are essential steps toward fulfilling their constitutional protection.
