Abstract: This scientific research highlights the precariousness of the Brazilian prison system and how this has seriously harmed human dignity. The objective of this study is to seek to elucidate, in a concise manner, to the academic, legal and general public, that even though fundamental rights are guaranteed by the Federal Constitution of 1988, these rights are still drastically disrespected in modern times. Regarding the methodology, the study will use a qualitative approach, bibliographic review and systemic analysis of the literature, the purpose of which is to emphasize the importance of the topic in the sphere of restriction of individual freedom. It is of total academic, legal and social relevance because it corroborates a better understanding of how the issue of the precariousness of the Brazilian prison system has been dealt with, which, instead of being a humanized system, suffers from harmful prison conditions. Concluding that inmates in the national prison system have been living in precarious conditions in prisons, with their fundamental rights being disrespected, with no one to turn to, since those responsible for guaranteeing their fundamental rights and guarantees are the main offenders.
