O SISTEMA PRISIONAL BRASILEIRO E A DIGNIDADE DA PESSOA HUMANA

Essa pesquisa científica destaca a precariedade do sistema prisional brasileiro e como isto tem ferido de forma eminente a dignidade da pessoa humana. O objetivo deste estudo é procurar elucidar de forma suscinta para o meio acadêmico, jurídico e sociedade em geral, que mesmo estando os direitos fundamentais garantidos pela Constituição Federal de 1988, estes, ainda em tempos hodiernos, são drasticamente desrespeitados. No que diz respeito à metodologia, o estudo recorrerá a uma abordagem qualitativa, de revisão bibliográfica e a análise sistêmica da literatura, cuja finalidade é enfatizar a importância do tema na esfera da restrição da liberdade do indivíduo. É de total relevância acadêmica, jurídica e social por corroborar para uma melhor compreensão de como vem sendo tratada a questão da precariedade do sistema prisional brasileiro que ao invés de ser um sistema humanizado, sofre com as nefastas carcerárias. Concluindo que os detentos do sistema prisional pátrio têm vivido em situações precárias nos presídios, sendo desrespeitados em seus direitos fundamentais, não havendo a quem recorrerem, já que os responsáveis por garantir seus direitos e garantias fundamentais são os principais infratores.

  • Abstract: This scientific research highlights the precariousness of the Brazilian prison system and how this has seriously harmed human dignity. The objective of this study is to seek to elucidate, in a concise manner, to the academic, legal and general public, that even though fundamental rights are guaranteed by the Federal Constitution of 1988, these rights are still drastically disrespected in modern times. Regarding the methodology, the study will use a qualitative approach, bibliographic review and systemic analysis of the literature, the purpose of which is to emphasize the importance of the topic in the sphere of restriction of individual freedom. It is of total academic, legal and social relevance because it corroborates a better understanding of how the issue of the precariousness of the Brazilian prison system has been dealt with, which, instead of being a humanized system, suffers from harmful prison conditions. Concluding that inmates in the national prison system have been living in precarious conditions in prisons, with their fundamental rights being disrespected, with no one to turn to, since those responsible for guaranteeing their fundamental rights and guarantees are the main offenders.
