O SISTEMA PENITENCIÁRIO BRASILEIRO E A VIOLAÇÃO DOS DIREITOS HUMANOS COMO FATOR IMPEDITIVO DE RESSOCIALIZAÇÃO
O presente estudo tem por escopo analisar o problema - já consabido - do sistema carcerário brasileiro, ante a inegável discrepância entre a realidade prisional e o que é preconizado em nossa legislação. O mundo está mudando para além da imaginação. A pandemia global deixou nossas sociedades mais pobres e mais frágeis, aprofundando as desigualdades existentes tanto dentro como entre países e regiões. Nesse contexto, serão analisados quais fatores contribuem para o grande índice de ineficácia na ressocialização dos apenados pátrios, partindo da premissa de o Brasil ser um dos países signatários principais de convenções e acordos internacionais de Direitos Humanos, todavia, dentro da realidade do atual sistema prisional tais direitos são amplamente mitigados, quando não, simplesmente inexistentes. Logo, procurar-se-á demonstrar que o Estado é o principal responsável pela não recuperação e ressocialização do apenado.

Abstract:
The present study aims to analyze the problem - already known - of the Brazilian prison system, given the undeniable discrepancy between the prison reality and what is recommended in our legislation. The world is changing beyond imagination. The global pandemic has left our societies poorer and more fragile, deepening existing inequalities both within and across countries and regions. In this context, it will be analyzed which factors contribute to the high rate of ineffectiveness in the resocialization of patriotic convicts, based on the premise that Brazil is one of the main signatories of international human rights conventions and agreements, however, within the reality of the current prison system such rights are largely mitigated, if not, simply non-existent. Therefore, we will try to demonstrate that the State is the main responsible for the non-recovery and resocialization of the convict.
