O SISTEMA DE GARANTIA DE DIREITOS DA CRIANÇA E DO ADOLESCENTE E OS DESAFIOS À PROTEÇÃO INTEGRAL
O presente capítulo busca apresentar as conquistas históricas dos direitos de crianças e adolescentes no Brasil, evidenciando que essas mudanças ocorreram de forma lenta e gradual até a promulgação da Constituição Federal de 1988 e do Estatuto da Criança e do Adolescente. Diante desses avanços, esse segmento da população alcançou o status de sujeito de direito e passou a prevalecer a teoria da proteção integral que estabeleceu a tríplice responsabilidade compartilhada entre família, sociedade e Estado. Instituiu-se a perspectiva de um Sistema de Garantia de Direitos em que órgãos lidam com crianças em situação de risco ou vulnerabilidade e devem agir de maneira organizada e intersetorial com outras políticas para garantir àquela criança uma efetiva proteção. Contudo, o que se observa é uma dificuldade na efetivação dos direitos garantidos em lei e alguns obstáculos que inviabilizam a atuação conjunta e integrada desses órgãos, em virtude da prevalência de princípios neoliberais, que se opõem ao paradigma da proteção integral à infância no país.

Abstract:
This chapter seeks to present the historical achievements of the rights of children and adolescents in Brazil, showing that these changes occurred slowly and gradually until the promulgation of the 1988 Federal Constitution and the Child and Adolescent Statute. In view of these advances, this segment of the population reached the status of subject of law and the theory of comprehensive protection prevailed, which established the triple responsibility shared between family, society and the State. The perspective of a Rights Guarantee System was instituted in which bodies deal with children at risk or vulnerability and must act in an organized and intersectoral manner with other policies to guarantee that child effective protection. However, what is observed is a difficulty in the realization of the rights guaranteed by law and obstacles that prevent the joint and integrated performance of these bodies due to the prevalence of neoliberal principles, which is opposed to the paradigm of comprehensive child protection in the country.
