Abstract: The present study intends to address one of the most discussed fundamental rights regarding its applicability in criminal practice, whether in the procedural phase, as well as in the inquisitorial phase. This is the right to silence, provided for in article 5, item LXIII, of the Federal Constitution of 1988. This fundamental right is derived from the principle of non-self-incrimination, known as “nemo tenetur se detegere” originated from the Pact of São José da Costa Rica . The present study also intends to explain its applicability, extension and predictability in the Brazilian legal system.
