Abstract: This scientific article deeply analyzes the intricate reality of the Brazilian funeral sector, thoroughly investigating the impacts of the insufficiency of Regulatory Standards (NRs) nº 1 and nº 15. The analysis primarily focuses on the delicate issue of unhealthiness and the complex challenges that legal certainty poses, affecting both employers and employees equally. The absence of specific regulations for such unique activities, like thanatopraxy, has proven to be fertile ground for the proliferation of legal uncertainties, resulting in a worrisome accumulation of labor liabilities and the consequent weakening of occupational risk management in companies. Our study, therefore, does not merely point out regulatory gaps; it aims to go further, suggesting a concrete set of guidelines, with the unequivocal purpose of strengthening legal certainty and improving biosafety practices throughout the segment. The methodology guiding this investigation was based on exhaustive bibliographic research, complemented by a meticulous survey of labor jurisprudences directly related to the funeral sector, with a special focus on unhealthiness issues, culminating in a careful analysis of current regulations. The research findings reveal a worrying trend: the constant judicialization of claims involving unhealthiness, frequently culminating in the recognition of the maximum degree, largely due to the subjective interpretation of the standards. We conclude, therefore, on the imperative need for urgent regulatory updates, with the priority inclusion of specific annexes capable of comprehensively addressing both biological and psychosocial risks inherent to the nature of the activity. The adoption of formal biosafety protocols and the improvement of sanitary control are equally fundamental to pave the way for greater legal certainty in the sector.
