O RELATOR E A ENCENAÇÃO DO MÚLTIPLO: ANÁLISE DOS ATORES DISCURSIVOS E DA GESTÃO DOS SEUS PONTOS DE VISTA NO DISCURSO JURÍDICO
Este estudo tem como proposta
analisar o modo de organização do discurso
jurídico proferido pelo ministro relator
Ayres Britto, em 2011, na Ação Direta de
Inconstitucionalidade (ADI) 4277 em conjunto
com a Arguição de Descumprimento de
Preceito Fundamental (ADPF) 132, em que se
discutia a equiparação da união estável entre
pessoas do mesmo sexo ao entendimento de
entidade familiar. Para a construção da análise
do discurso do referido corpus, serão utilizados
como referenciais teóricos os artigos Tiers où
es-tu? de Patrick Charaudeau (2004) e O Papel
do Enunciador na Construção Interacional
dos Pontos de Vista de Alain Rabatel (2013).
O objetivo é avaliar como o relator dessa
arquitetônica jurídica investe-se subjetivamente
no tratamento da decisão jurisdicional, evocando
terceiros discursivos, para fundamentar seu
entendimento de que a sexualidade, entendida
como “bruta flor do querer”, é um direito subjetivo
de grandeza constitucional que espelha as
redes de afetos e desejos insondáveis entre as
pessoas humanas.

Abstract:
The purpose of this study is to
analyze the legal discourse delivered by the
Rapporteur, Ayres Britto, in 2011, in the Direct
Action of Unconstitutionality (ADI) 4277, in
conjunction with the Arrangement of Noncompliance with Basic Precept (ADPF) 132, in
which the equation of the stable union between
persons of the same sex was discussed to
the understanding of familiar entity. For the
construction of the analysis of the discourse
of said corpus, the articles Tiers où es-tu? by
Patrick Charaudeau (2004) and The Role of the
Enunciator in the Interactive Construction of the
Points of View by Alain Rabatel (2013) will be
used as theoretical references. The objective
is to evaluate how the rapporteur of this legal
architect invests subjectively in the treatment of the jurisdictional decision, evoking
discursive third parties, to substantiate his understanding that sexuality, understood as
the “raw flower of the will,” is a subjective right of constitutional grandeur that mirrors
the networks of unfathomable affections and desires among human persons.
