O PROCESSO INQUISITORIAL 8064 À LUZ DA MICRO-HISTÓRIA
A Inquisição foi um importante
movimento atemporal que perquiriu e combateu
o que foi designado como heresia (séculos XIIIXVIII).
Contudo, o meio de prova foi o importante
vínculo entre a História com o Direito. A partir
desse veículo foi possível definir quem é o
sujeito na sociedade. Isso é histórico e jurídico.
Como exemplo emblemático desse viés
apresenta-se o Auto de Fé irrogado em face do
padre jesuíta Gabriel Malagrida, registrado na
Ata de execução do Santo Ofício onde consta
a Sentença de sua execução no Código do
Manuscrito – Ordem Real N.13. Lisboa, 20 de
setembro de 1761. O processo inquisitorial
foi envolto de grandes questionamentos
historiográficos e jurídicos, onde a História
define os padrões teóricos e contextuais em
que tais mecanismos foram produzidos. Por
sua vez o Direito empresta os conceitos e
auxilia na hermenêutica, propiciando o melhor
entendimento das instituições e métodos de
aplicação das normas. Com ênfase no processo
inquisitorial, especialmente aquele verificado
em terras lusas no Setecentos, é possível
concluir e auferir como o meio de prova define
o sujeito e lhe concede uma identidade

Abstract:
The Inquisition was an important
timeless movement that sought and fought
what was designated as heresy (13th-18th
centuries). However, the evidence was the
important link between History and Law. From
this vehicle it was possible to define who
the subject is in society. This is historical and
legal. As an emblematic example of this bias,
the Auto de Fé is presented in the face of the
Jesuit priest Gabriel Malagrida, recorded in
the Act of execution of the Holy Office, which
includes the Judgment of its execution in the
Manuscript Code - Royal Order N.13. Lisbon,
September 20, 1761. The inquisitorial process
was surrounded by great historiographical and
juridical questions, where History defines the
theoretical and contextual patterns in which such
mechanisms were produced. In turn Law lends
concepts and assists in hermeneutics, providing
a better understanding of the institutions and
methods of applying the norms. With emphasis
on the inquisitorial process, especially that
verified in Portuguese Lands in the Seventy, it is
possible to conclude and learn how the medium
defines the subject and gives it an identity.
